The general terms of business apply to all users.
Visitors to the website agree to comply with the General Terms of Business and Purchase listed here, as well as all applicable laws and regulations of the Republic of Croatia.
The general terms of business are in accordance with the laws of the Republic of Croatia. MONTARO craft business holds the copyright to all content published on www.montaro.hr. Content from the website may not be used without the permission of the MONTARO craft business.

The MONTARO craft business reserves the right to change the General Terms of Business, Purchase, and use of this website at any time. Changes take effect upon publication, and the user will be notified by email. By accessing the website, the user is considered to be aware of the current rules and conditions of use, and this is confirmed at the time of purchase confirmation.
Photographs and representations of products on www.montaro.hr and on partner pages may differ from the actual state due to different displays on various screens and devices.
Purchasing
A customer of the MONTARO online store can only be an adult person with full legal capacity. By purchasing from the MONTARO online store, the customer agrees to the sales and delivery conditions as well as to the General Terms of Business and Purchase. The customer purchases products in the MONTARO online store on the website www.montaro.hr by selecting them based on the image and basic description of the product. The order of the product is made electronically by adding the product to the cart. A product is considered purchased once the entire ordering process is completed. The MONTARO online store is available 24 hours a day, 7 days a week.
The sales contract between the customer and the MONTARO craft business becomes valid upon receipt of the ordered shipment.
The MONTARO craft business is obliged to deliver all ordered and paid products that are available in stock at the time of delivery. In the event of an inability to deliver, the MONTARO craft business will contact the customer to arrange a new delivery date, a substitute product, or to cancel the ordered product, while the other available products will be delivered. In the case of an inability to deliver the ordered and paid product, the MONTARO craft business will issue a refund.
Delivery
Delivery Prices
Product prices are expressed in euros. The MONTARO craft business is not registered for VAT. The delivery price is calculated at the end of the ordering process. For orders delivered within the Republic of Croatia, the delivery costs are covered by the MONTARO craft business. In the case of orders delivered via GLS delivery service, the customer pays a delivery fee of €5.
For orders delivered within the EU, the user bears the delivery costs of €5 for orders valued up to €80, while for orders over €80, the delivery costs are covered by the MONTARO craft business.
For orders delivered outside the EU, the user bears the delivery costs of €13 for orders valued up to €100, while for orders over €100, the delivery costs are covered by the MONTARO craft business.
Offers and prices for special promotions are valid until the deadline specified on the website or until stocks last.
Order Confirmation
The customer of the MONTARO online store will receive a notification of order confirmation via email after completing the purchase. The order confirmation notification contains all legally required information.
The user agrees that all communication will be conducted electronically via email and is responsible for providing a correct email address for order submission, receiving order confirmation, and receiving information about the planned delivery of the ordered goods from the delivery service. The MONTARO craft business is not responsible in case the provided email address is incorrect or in case of technical settings on the user's computer that prevent the email from being delivered.
Payment Methods
Payment
Products purchased in the MONTARO online store can be paid for in the following ways:

Cash on Delivery: For the area of Croatia. The user pays the amount for the ordered goods and any delivery costs directly to the delivery person upon receipt.

Internet Banking or General Payment Slip: Users must send all necessary payment details to the provided email address. Goods will be shipped once the payment is visible in the MONTARO craft's bank account.

Debit or Credit Card: Payments made via debit or credit cards are processed through the Stripe payment system. For legal information and security details, please check the Stripe website: https://docs.stripe.com/security.
Delivery
Delivery of ordered goods is carried out by a delivery service.
The delivery price is calculated at the end of the ordering process. The delivery price depends on the value of the ordered goods:

For ordered goods delivered within the Republic of Croatia, the delivery costs are covered by the MONTARO craft business. For orders delivered within the EU, the user pays delivery costs of €5 for orders valued up to €80, while for orders over €80, the delivery costs are covered by the MONTARO craft business.

For orders delivered outside the EU, the user pays delivery costs of €13 for orders valued up to €100, while for orders over €100, the delivery costs are covered by the MONTARO craft business.
Users will be notified via email by the delivery service regarding the delivery time of the ordered goods, and it is their responsibility to receive the package within the time frame set by the delivery service.
All orders received on working days (Monday to Friday) before 11 a.m. will be processed the same day. The delivery timeframe depends on the conditions set by the delivery service. Orders received on Sundays and public holidays will be sent on the next working day.
If for any reason the delivery of ordered goods is not possible, the customer will be notified via email and/or phone.
If the package does not arrive within the specified timeframe after receiving a notification that the shipment has been dispatched, the customer can request confirmation of shipment from the seller to check the status of the package.
If the customer does not collect the package within the designated timeframe, MONTARO reserves the right to charge for return shipping and the costs of resending the package to the desired address. Delivery costs and times to islands may be higher according to the delivery service's price list.
Returns / Complaints on Delivered Products
All products are thoroughly inspected before delivery and are shipped undamaged and in proper condition. All products are packed in transport boxes in their original packaging to ensure they arrive undamaged.
The customer has the right to return goods to the seller after delivery if:
- They received goods they did not order.
- They received goods with defects or visible damage.
The customer is obliged to check for any damages upon receiving the package and to immediately report them to the delivery person. If receiving the package at a delivery office, the customer should request the creation of a Damage Report and refuse to accept the shipment. In that case, the shipment will be returned to the seller, and the customer will receive a new shipment.
The customer has the right to return incorrectly delivered items or damaged items. The seller will approve the return after mutual agreement (by phone or email), providing instructions for the return and will send the customer a new shipment at no additional cost.
The customer does not have the right to return opened/used products.
The deadline for all complaints is 15 days from the receipt of goods. Complaints can be sent via email to: info@montaro.hr or by phone at +385 (0) 91 1975737.
To enable MONTARO to accept a complaint, the product must be returned in its original packaging, unused and undamaged (unless the reason for the complaint is product damage), along with the original invoice received by the customer. To simplify the return process, it is necessary to fill out the Form for Unilateral Termination of Contract after purchasing products remotely and send it to info@montaro.hr. After that, the item or items the customer wishes to return should be sent by post. The returned item must be in its original packaging. The original packaging must not be damaged. The package must clearly indicate in large letters: RETURN. MONTARO reserves the right to refuse items that are not returned in accordance with the above rules. If the customer returns an item for any reason, they will bear the direct costs of returning the goods. In the event of a packaging error, MONTARO will cover the postage in both directions (the delivery service is chosen by the MONTARO craft business).
Return Address for Goods
The customer can send the return via a delivery service of their choice.
MONTARO reserves the right to take up to 5 days to process the return from the delivery of the customer's package. Once MONTARO receives the package, the items will be inspected, and the request will be processed within 24 hours of receipt, excluding non-working days and holidays.
If the customer wants a refund, it will be processed as soon as possible. The refund will be made in the same way as the item was paid for, either by bank transfer to the current account or by canceling the card payment within 5 working days. Refunds can only be made after the goods are returned.
Right to Unilateral Termination of the Contract
The consumer has the right to unilaterally terminate the contract in accordance with the provisions of the currently active legal act, accepting all rights and obligations in the case of the same (deadline, costs of return shipping, reduction in the value of the goods, etc.).
Out-of-Court Resolution of Consumer Disputes
In the event of a dispute between the customer and the seller, a complaint can be submitted to the Court of Honor of the Croatian Chamber of Commerce, the Court of Honor of the Croatian Crafts Chamber, or a proposal for mediation at mediation centers. The procedure before the courts of honor is conducted according to the Rules of the Court of Honor of the Croatian Chamber of Commerce and the Rules of the Court of Honor of the Croatian Crafts Chamber, which state that the members of the councils of these courts, in addition to independent legal experts and representatives of traders, also include representatives of consumers.
Mediation before mediation centers is conducted in accordance with the provisions of the Mediation Act and the Rules of Mediation of the Mediation Center of the Croatian Chamber of Commerce and the Croatian Crafts Chamber. The Croatian Chamber of Commerce and the Croatian Crafts Chamber, with the consent of the minister responsible for consumer protection, will decide on the costs in the procedures before the Court of Honor of the Croatian Chamber of Commerce and the Court of Honor of the Croatian Crafts Chamber.
Product Statement
MONTARO wishes to receive feedback on products and has the right to publish selected comments on its website while retaining the right to review your comments and publish them in other marketing materials.
Personal Data Protection
Data Retention
MONTARO retains personal data in accordance with applicable legal regulations. Users can request the deletion of their personal data from the MONTARO user database or the cessation of marketing messages at any time by sending an email with the appropriate request to info@montaro.hr.
MONTARO stores personal data as long as necessary for the purposes for which it is processed or to comply with the law. Personal data processed based on the user’s consent is stored permanently until the user withdraws consent. Personal data processed based on legal or contractual obligations is retained as long as mandated by law (11 years from the issuance of the invoice) or for the duration of the contract plus an additional 5 years after termination (which is the general statute of limitations). After the retention period expires, personal data is effectively and permanently deleted or anonymized so that it can no longer be linked to an individual.
Registration
To make a purchase in our online store, registration is not mandatory. It is only necessary to provide a valid email address (to which you have access) in the first step of the checkout process to receive an order confirmation after entering the required delivery information. If you do not wish to enter the delivery address and payment information each time you make a purchase, quick registration is recommended. You only need to enter a valid email address, personal information (first name, last name, address, postal code, city, phone number), and a password to access your user account. The password can be any string of characters— the longer it is, the more resistant it is to hacking attempts.
After entering the required information, you need to confirm the registration by clicking the "Register" field. The created user account remains registered in the system, and you can access it using the username and password on the "Login" page.
If you forget your password, you need to click on "Forgot Password?" on the same page. You will be taken to a page where you can enter the email address with which you registered on the web shop, and the system will automatically send you a link to reset your password and get a new one. You can later change this password yourself in the account settings since automatically generated passwords are not easy to remember (or just click YES when your browser asks to remember the entered password so you don’t have to enter it each time you log in).
In summary, after creating an account, only your username and password login will be required for every subsequent purchase.

All collected data is used solely for the business relationship of MONTARO and for you as a user of our services. The collected data is used to realize the business relationship, better understand the needs of our users, inform users about all benefits, promotions, and other marketing purposes, and for informational purposes. The collected data will not be provided to third parties, except in cases prescribed by law. Users can request the deletion of their personal data from the MONTARO database or the cessation of marketing messages at any time by sending an email with the appropriate request to info@montaro.hr. Users agree that all communication is conducted electronically via email and are responsible for providing a correct email address for submitting orders, receiving order confirmations, and receiving information about the planned delivery of ordered goods from the delivery service. MONTARO is not responsible if the provided email address is incorrect or due to the technical settings of the user's computer that prevent the email from being delivered.
The protection of your personal data means that:
- We will never misuse your personal data in any way.
- We will never give your contact and personal data to any third party.
- Your contact and personal data may be disclosed to a third party only with your permission.
- You can unsubscribe from any of our email lists at any time.
All our online activities comply with European legislation and the national legislation of the Republic of Croatia, and we have appointed a data protection officer in accordance with them.
MONTARO is committed to protecting customer personal data by collecting only necessary, basic customer data needed to fulfill our obligations, informing customers about how their data will be used, regularly providing customers with the option to choose whether or not to use their data, including the option to decide whether they want their name removed from the lists used for marketing campaigns. All user data is strictly protected and accessible only to employees who need this data to perform their jobs. All employees of MONTARO and business partners are responsible for adhering to the principles of privacy protection.
The websites contain information about products and services offered by MONTARO. The pages serve as an electronic sales point for the MONTARO craft. MONTARO cannot accept responsibility for any damages resulting from the use of information from these pages for purposes beyond their intended use. Tracking Website Visits
Like most websites, this site uses Google Analytics (GA) to track user interactions. We use this data to determine the number of people using our website to better understand how they find and use our site and to see their journey through the website. While GA records data such as your geographic location, your device, internet browser, and operating system, none of this data can personally identify you. GA also records the IP address of the computer, which could be used for personal identification, but Google does not provide us access to that. We consider Google a third-party data processor.

Email Address
If you contact us via the contact email address, none of the data you provide will be stored on this website and will not be transferred/processed by any third-party data processors. Instead, data will be collected in the email and sent to us via Simple Mail Transfer Protocol (SMTP). Our SMTP servers are secured with TLS (sometimes known as SSL), which means that the content of the email is encrypted using SHA-2, 256-bit cryptography before sending over the internet. The content of the email is decrypted on our local computers and devices.
If you choose to subscribe to our Newsletter, the email address you provide will be forwarded to the software platform that provides us with email marketing services. The email address you send will be stored in the database of that platform. Your email address remains in the database of that platform as long as we continue to use the services of that platform for email marketing or until you request to unsubscribe from the newsletter list.
